1. ORGANIZER OF TRAINING OR EVENT
1. The organizer of the trainings and events (hereinafter referred to as the “event”) covered by these regulations is the company OceanBerg Sp. z o.o. (hereinafter referred to as “OceanBerg” or “Organizer”) with its registered office in Warsaw, ul. Twarda 18, 00-105 Warsaw, KRS 0000391780.
2. PARTICIPATION REGISTRATION
1. To register for participation in the event, one must:
fill out a paper or electronic form and send the scanned document electronically to the contact details provided on the OceanBerg website
or
fill out the online form available on the OceanBerg website (the form does not require the service orderer's signature and is equivalent to acceptance of these regulations).
2. Registration for participation in the event is equivalent to the orderer's acceptance of the terms of participation in the event resulting from the order and these General Terms and Conditions.
3. The orderer may designate a person registering more than one participant if the internal organizational regulations of the registrant allow for this and comply with the applicable data protection regulations. OceanBerg does not verify the processes on the registrant's side and their compliance with the regulations.
3. ENTRY ON THE LIST OF PARTICIPANTS
1. Within 5 working days of delivering the registration form to the Organizer, the orderer will receive confirmation of the participant's entry on the event list via e-mail – Confirmation of participation in the event.
2. A binding contract for the provision of training services is concluded when the Organizer confirms that the event will take place, and the registrants have received confirmation of participation in the event.
3. After submitting the registration, but no later than 10 days before the event date, the orderer will receive detailed information regarding participation in the event.
4. The number of places at events is limited. The order of incoming registrations is decisive.
5. OceanBerg reserves the right to refuse to register a participant or participants on the list without giving a reason. Lack of registration confirmation means that the participant has not been registered on the list of event participants.
4. EVENT PRICES AND PAYMENT TERMS
1. Unless otherwise stated in the event description, a prerequisite for participation in the event is making a prepayment to the specified bank account or via available payment methods.
2. Unless otherwise specified, the prepayment must be made no later than 7 days before the event starts.
3. Unless otherwise stated in the event description, the prices provided are net prices to which the applicable VAT tax must be added.
4. The prices of open events organized include only the package specified in the event description. In particular, the prices of events usually do not include costs for: accommodation, travel, parking for participants. The scope of closed events is determined individually.
5. CANCELLATION OF PARTICIPATION AND WITHDRAWAL FROM THE CONTRACT
1. Cancellation of participation in the event must be reported to OceanBerg no later than 10 working days before the event starts.
2. In case of cancellation within less than 10 working days before the event date, the registrant is obliged to cover the CHARGE NOTE issued for an amount equal to 80% of the net value of the event or events in question.
3. At any time prior to the start of the event, the registrant may designate another participant from their organization or a related organization (organizationally or ownership-wise). The change of participant must be communicated in writing (via email) to an OceanBerg employee.
4. If during the sessions a participant disrupts the conduct of classes or poses a threat to themselves or other participants, OceanBerg has the right to refuse the participant further participation in the event, and in such a case, no refund of participation costs for that participant will be due.
5. At least 7 days before the planned start of the event, OceanBerg will finally confirm the realization of the event. The event may be canceled by OceanBerg, and in such a case, participants will be notified, and prepayments will be refunded or allocated towards the participation fee in another OceanBerg event.
6. In case of cancellation of the event by OceanBerg, OceanBerg is not responsible for any costs incurred by participants or their organizations related to the event.
7. If the orderer is a consumer within the meaning of the Civil Code, who has concluded a contract for participation in the event at a distance (e.g., through an online form or via email), they have the right to withdraw from the contract without giving reasons within 14 days from the date of its conclusion, pursuant to the Consumer Rights Act of May 30, 2014.
8. According to Article 38, paragraph 1, item 1 of the Consumer Rights Act of May 30, 2014, the consumer loses the right to withdraw from the contract if the service (participation in the event) has been fully performed with their explicit consent before the expiry of 14 days from the conclusion of the contract.
9. By registering for participation in the event and accepting these regulations, the consumer consents to the commencement of the service provision before the expiry of the withdrawal period and is aware that in such a case they will lose the right to withdraw.
10. To exercise the right of withdrawal from the contract, the consumer must submit an unambiguous statement of withdrawal from the contract, sending it, for example, to the email address: info@oceanberg.com or by post to the registered office address of OceanBerg.
11. In the case of effective withdrawal from the contract, OceanBerg will refund all received payments promptly, no later than 14 days from the date of receiving the consumer's statement.
12. The right to withdraw from the contract does not apply in cases indicated in Article 38 of the Consumer Rights Act, in particular, if:
1. the event (training service) has been fully performed with the explicit consent of the consumer before the expiry of the withdrawal period,
2. the event starts before the expiry of the 14-day period, and the consumer has been informed about the loss of the right to withdraw from the contract in such a case.
6. CHANGES TO THE EVENT DATE
1. OceanBerg Sp. z o.o. reserves the right to change the date of the event if its organization is not feasible or commercially justified on the original date.
2. If the new date is not accepted, the orderer has the right to withdraw from the event and a refund of the payments made.
3. If anything disrupts the realization of the event, OceanBerg will make every effort to continue it after a break. All events completed in at least 70% of the time or material program are considered to have been fully realized.
7. CERTIFICATE OF COMPLETION OF THE EVENT
1. The event description may include information about the issuance of certificates of participation or completion of the event. Certificates, unless stated otherwise in the description, cannot be considered as professional qualifications or certificates required formally by law.
2. The condition for obtaining a certificate of completion of the event is participation in all days of the event in at least 80% of the sessions.
8. ADDITIONAL INFORMATION
1. Materials provided to participants during the event are protected by copyright. The orderer and/or participant has the right to use them only within the limits of personal use. Copying, reproducing, or distributing these materials infringes on the ownership rights to these materials and may result in claims against the participant and the organization that registered them for the event.
2. Participants are entitled to share fragmentary materials from the event on photos and social media posts: up to 3 slides, up to 30 seconds of recording.
3. Events take place at a location indicated by the Organizer depending on the type of event. Participants will be informed about the location of the event prior to its commencement.
4. The Organizer reserves the right to conduct monitoring of the event by employees of the company and authorized external units.
9. PERSONAL DATA PROTECTION
1. The administrator of personal data of the orderer and participants is OceanBerg, and all basic regulations concerning personal data are included in OceanBerg's policy: link >>
2. During the event, the Organizer or designated third parties may record the event and take photographs. The content recorded in this way may include the image of individual participants and be published in the Organizer's materials and on social media for promotional or commercial purposes, which each participant has been informed about in this regulation. If a participant does not agree to the public display of their image, they may submit such a request to the Organizer. A participant has the right to object to the processing of their image at any time by sending an email to the Organizer's address.
3. The registrant assumes the informational obligation arising from current legal regulations to inform the event participants whose personal data are processed, as well as about their right to access their personal data, request their correction or deletion.
10. GENERAL
1. The registrant undertakes to inform the participants of the event about the content of these regulations.
